LANSING, Mich. (Michigan News Source) – After Macomb County Prosecutor Pete Lucido cleared four people of wrong doing for allegedly voting twice in the August Primary Election, Attorney General Dana Nessel announced she’s going to charge them and three assistant clerks with criminal election fraud.
Who is charged?
The four voters charged include St. Clair Shores residents 68-year-old Frank Prezzato, 56-year-old Stacy Kramer,44-year-old Douglas Kempkins, Jr. and 62-year-old Geneva O’Day. They all face one count of Voting Absentee and In-Person, which is a maximum penalty 5-year felony. In addition, they are each charged with one count of Offering to Vote More than Once, a maximum penalty 4-year felony.

Assistant Clerks Patricia Guciardo 73, and Emily McClintock, 42, are each charged with one count of Falsifying Election Returns or Records, one count of Voting Absentee and in Person, and one count of Offering to Vote more than Once. Assistant Clerk Molly Brasure, 31, faces two counts of Falsifying Election Returns or Records and two counts each of Voting Absentee and in Person, and Offering to Vote more than Once.

Originally, Lucido cleared the four voters because he said the intent was not to vote twice. He said the people believed they had spoiled their ballots correctly.
However, Nessel’s office alleges when the voters showed up on election day, poll volunteers told them their absentee ballots had already been received. The Electronic Poll Book showed they had already voted by absentee ballot, and that that ballot had been received by the local clerk. Nessel alleges the election workers were instructed by Guciardo, McClintock, and Brasure to override the system warnings and issue in-person ballots. The voters cast these ballots, which were then counted alongside their absentee ballots, and resulted in double votes. In addition, the assistant clerks are accused of illegally altering the State Qualified Voter File.
