LANSING, Mich. (Michigan News Source) – The lawsuit filed by Michigan Attorney General Dana Nessel to shut down Enbridge Energy’s Line 5 in the Straits of Mackinac has been bumped back to state court.
Enbridge had requested in June that the Court of Appeals rehear its request to have the case heard in federal court. However, the Sixth Circuit Court of Appeals has denied to hear the motion again and the case stays in state court.

Nessel has claimed the reason she and the Whitmer administration want to shut down Line 5 is to prevent pollution, although there have been no disasters caused by Enbridge Energy in the Straits of Mackinac.
“It is a critical responsibility of the State to protect our Great Lakes from the threat of pollution,” Nessel said in a press release. “Our state claims, brought under our state law, will continue to be heard in a state court, and I am grateful we are one step closer to resolving this case on behalf of the state of Michigan.”
Meanwhile, Enbridge is moving forward with a $500 million tunnel to encase Line 5. It provides most of the propane for the Upper Peninsula and parts of the Lower Peninsula.
