LANSING, Mich. (Michigan News Source) – Michigan Representative Steve Carra (R-Three Rivers) called on Attorney General Dana Nessel to investigate what he says is the “unconstitutionality of [Supreme Court Justice] Kyra Harris Bolden’s appointment.”
In a two-and-a-half page letter released on Thursday, Rep. Carra claims Bolden’s appointment by Gov. Gretchen Whitmer in November is unconstitutional. Specifically, he cites Article 4, Section 9 of the Michigan Constitution which states: “No person elected to the legislature shall receive any civil appointment within this state from the governor, except notaries public, from the legislature, or from any other state authority, during the term for which he is elected.”

Carra argues that Bolden’s service as representative in Michigan’s 35th House district, which was not set to expire until January 1, 2023, also excludes her from the appointment.
Harris Bolden made an unsuccessful run for a seat on the Michigan Supreme Court and lost in November. Two weeks later, Gov. Gretchen Whitmer appointed her to fill the vacant slot left open by Chief Justice Bridget McCormack’s retirement.
