LANSING, Mich. (Michigan News Source) – Proposal 3, which Michigan voters passed overwhelmingly on Tuesday, will enshrine abortion rights in the Michigan constitution and become official on December 23.
According to the ballot language, Proposal 3 will grant “reproductive freedom,” which is defined as “the right to make and effectuate decisions about all matters relating to pregnancy, including but not limited to prenatal care, childbirth, postpartum care, contraception, sterilization, abortion care, miscarriage management, and infertility care.”

The group “Reproductive Freedom for All” sponsored the measure while Citizens to Support MI Women and Children fought against it.
Proposal 3 ends a 1931 ban on abortion when it takes effect in December, and nixes prosecution of abortion providers. Michigan mothers who have abortions cannot be prosecuted for abortion under a 1963 Michigan Supreme Court ruling.
Legal challenges to Proposal 3 are expected.
While some believe the measure will restore the same rights granted by the landmark U.S. Supreme Court case Roe v Wade, others are saying there’s much to be gleaned from the fine print.
Attorney David Kallman told Michigan News Source on Thursday, “This goes way beyond Roe. It secured the most extreme abortion law in our country. It allows abortion up to the moment of birth. They did it through clever wording and then they lied about it.”
In addition, Kallman wrote a piece which spelled out the different aspects of Proposal 3. “Proposal 3 creates a fundamental right for all individuals, including minors, to receive sterilization treatment, a common aspect of the gender transition process,” he wrote.

Kallman said it may take awhile for pro-Proposal 3 voters to realize the ramifications of their “yes” vote.
“When a parent says, ‘My 13-year-old daughter had an abortion and no one told me?’ ‘My 15-year-old son got castrated and no one told me?’ It might create a groundswell to create a ballot proposal to undo [Proposal 3].”
