WASHINGTON (Michigan News Source) – Robert F. Kennedy Jr. is not backing down.

With less than two weeks to go before the Nov. 5 general election, Kennedy petitioned the U.S. Supreme Court to issue an injunction ordering Michigan Secretary of State Jocelyn Benson (D) to remove him from the ballot.

In the filing, Kennedy claimed Benson is violating his rights by not removing his name. Kennedy has gone toe-to-toe in court with Benson since August when he suspended his presidential campaign as the Natural Law Party candidate.  He also shifted his support behind former President Donald Trump. Kennedy has fought to keep his name off ballots in several states, but the courts ruled otherwise in Michigan.

Benson has claimed that Michigan election law does not allow minor party candidates to be removed once they accept the nomination. Others have accused her of partisanship, saying Kennedy’s name on the ballot helps the Democratic party.

The timing of the filing is interesting, as early voting in Michigan starts on Sat., Oct. 26. Absentee ballots are already being cast. Michigan is considered a battleground state which could swing the election with its 15 electoral votes.
