LANSING, Mich. (Michigan News Source) – It’s been a busy week in the courts for former presidential candidate Robert F. Kennedy, Jr. and Michigan Secretary of State Jocelyn Benson. Her office is seeking an an emergency decision from the state Supreme Court after losing in the Michigan Court of Appeals earlier in the day. It ordered  Kennedy Jr.’s name removed from the November ballot.

The unanimous ruling by the appeals court is likely to impact the expected close presidential race in Michigan, which is predicted to be a key battleground state. Friday’s decision followed Kennedy’s appeal of a lower court order earlier that week that would have kept him on the state’s ballot despite his withdrawal from the race and recent endorsement of Republican Donald Trump.

Essentailly, the judges ruled that although the request was made close to the key ballot and election deadlines, it still gives them enough time. They referred to a legal doctrine that lets a court deny relief because a claimant delayed making their claim.

“Additionally, we conclude that the absence of any statutory authority prohibiting his withdrawal gave plaintiff a clear legal right to have his name removed from the ballot,” the court said.
